Italian Antitrust Authority Announces it Will Not Proceed with Investigation into the Acquisition of Officine Maccaferri by Ambienta
(Teleborsa, 2nd April 2024) – The Italian Competition and Market Authority (AGCM) has decided not to start the investigation regarding the business deal in which Ambienta SGR will acquire a majority share of Officine Maccaferri, as it does not significantly impede the effective competition in the markets concerned and does not lead to the creation or strengthening of a dominant position.  The AGCM observes that in none of the relevant markets in which the target group operates are there companies belonging to the portfolio managed by Ambienta, nor in the downstream or upstream markets. Furthermore, considering that the operation does not involve any overlap in market shares, nor effects of a vertical nature, the Authority believes that it is not raising competitive issues in the reference markets, as it does not lead to structural changes.

Marines Call in to Replace Landfill Liner after Toxic Runoff and Failing Infrastructure
Commander Steve Ramsey, the public works officer at the base, said that costs have “not been insignificant.” He said that the Marines installed a temporary liner over the landfill that cost $4 million, almost as much as the original liner. Trash has since been diverted to the San Onofre landfill, a municipal facility they also own and run.  The water board’s enforcement order demands that Marines cease taking in new loads of waste until the system can face “100 year storm events” without discharging polluted water into storm drains. During the pause, they will also have to repair the torn liner, finish construction and pass a water board inspection.

Court Case over Geomembrane Liner for Coal Combustion Residue (CCR)
Midwest argues that the Board acted arbitrarily and capriciously by requiring removal of the impoundment liner because the Board (1) disregarded expert testimony that geomembrane liners are nonabsorptive and can be decontaminated, negating the requirement for removal, (2) lacked technical justification to require removal of the liner and associated equipment, (3) relied on factors the legislature did not intend it to consider—namely, the preamble to a proposed amendment to the federal regulation, and (4) made sudden and unexplained revisions to the rule. For these reasons, Midwest contends, section 845.750(a)’s requirement that operators electing closure by removal also remove the impoundment liner fails all three prongs of the Greer test.
