On 12 January 2021 the Regional Court in Warsaw (Poland) dismissed the motion by Concrete Canvas Technology Ltd. to issue a preliminary injunction to secure a claim concerning alleged infringement of patent PL/EP 2027319 by Eurobent sp. z o.o. By issuing that judgement, the Regional Court in Warsaw overturned a preliminary injunction which was granted on 6 August 2020 on the basis of one-sided presentation of facts and law by Concrete Canvas Technology Ltd.
The Judgement of 12th January 2021 is final and there are no further means of appeal in this matter.
The judgement finally proves, that there were no grounds to grant Concrete Canvas Technology Ltd. the security for the claims based on the allegation of infringement of patent PL/EP 2027319 by Eurobent sp. z o.o. through manufacturing TiltexTM products. Dismissal of motion for preliminary injunction means, that the court has found that the underlying claim is not even prima facie probable and/or the claimant lacks legal interest to secure the claim. The decision of 12 January 2021 thus entirely undermines all allegations of illegal conduct by Eurobent sp. z o.o. baselessly disseminated by Concrete Canvas, in particular in the press release of Concrete Canvas Technology Ltd of 26 August 2020.
