Court Finds Veolia Provided Outdated Data to an Expert Witness Regarding the Performance of its Landfill Gas Extraction System, which was Deemed Serious Trial Misconduct
Victorian Supreme Court found Veolia Environmental Services in breach of its landfill operating licence and the general environmental duty (GED) under the Environment Protection Act 2017 (Vic). The court determined that Veolia failed to implement all practicable measures to prevent excessive landfill gas emissions from its Hallam Road site between July 2022 and October 2023.
- Veolia submitted landfill gas extraction data to their expert witness that did not reflect the current operational conditions during the period of alleged environmental breaches (July 2022 – October 2023).
- This outdated data misrepresented the effectiveness of the gas control measures in place at the time of the emissions issue.
- The court viewed this as a failure to comply with the obligation of candour and fairness to the court in environmental litigation.

However, the geotextile bags were made of polypropylene woven fabrics, whose surface pore size can influence both the dehydration rate and the amount of tailings consolidated in geotextile bags.
