APPEAL BY EUROBENT SP. Z O. O. INCORRECTLY REJECTED FOR FORMAL REASONS
On 17 May 2021 the District Court in Świdnica has rejected for formal reasons the appeal by Eurobent sp. zo.o. from the decision of the District Court in Świdnica of 11 January 2021 r. obliging Eurobent sp. zo.o. to pay a compulsory sum of PLN 4,500,000 (approximately EUR 1 million). According to Eurobent sp. zo.o., this decision is wrong and results from an incorrect application by the District Court in Świdnica of new procedural regulations, which raise significant doubts on the court’s practice. Eurobent sp. zo.o. intends to appeal from it and remains convinced, that upon appeal, the justice system will correct this erroneous decision and subsequently repeal the decision of 11 February 2021 as well. It must be stressed, that this decision has resulted solely from application (in a faulty manner) of the rules of procedure, and does not confirm any accusation of infringement by Eurobent sp. zo.o. of intellectual property rights, nor acting in breach of any injunction. Eurobent sp. zo.o. is certain, that in the course of legal process it will prove that it has acted correctly and in full compliance with law. Christoph Terlinden, President of the Board”
